2. Agreement to these Terms
These Terms govern use of the KaivosFocus website and its available services. By registering for an account, placing an order, publishing content or using a feature, you agree to comply with these Terms, subject to applicable law.
Certain transactions and features are also governed by our Marketplace Licence Terms, Seller Terms, Refund Policy, Privacy Policy and Content Safety rules.
Where mandatory consumer or other applicable laws conflict with these Terms, those mandatory legal protections prevail.
3. Accounts and account security
Users must provide accurate information where required and keep their account credentials secure. You are responsible for activity conducted through your account to the extent permitted by applicable law.
You must not impersonate another person, create fraudulent accounts, bypass platform restrictions, misuse another account or interfere with website security.
Users must meet the legal age and eligibility requirements applicable to the services they use.
Contact KaivosFocus if you believe an account has been accessed without authorisation.
4. Platform services
KaivosFocus provides tools for creative portfolios, photography and video discovery, digital asset licensing, educational content, creator profiles, professional connections and related services.
Features may be introduced, modified or discontinued over time. Any material changes affecting paid services remain subject to applicable contractual and consumer rights.
KaivosFocus does not guarantee that every feature or transaction will be available in every country.
5. Marketplace and digital purchases
The KaivosFocus Marketplace enables eligible creators to list digital works and enables buyers to purchase defined licences for those works.
Each listing must accurately describe the content, applicable price and licence options available. Only the licence selected and recorded with a completed purchase is granted to the buyer.
A completed purchase does not automatically transfer copyright or ownership of the underlying creative work.
KaivosFocus provides marketplace infrastructure and payment coordination. Creators remain responsible for the rights, accuracy and lawful supply of their listed content, subject to applicable platform and consumer responsibilities.
6. Marketplace licensing
Marketplace assets may be offered under the licence options made available by the creator, including Standard, Extended and Full licences.
The duration, permitted commercial uses, restrictions and other conditions of a purchase are determined by the selected licence and the applicable Marketplace Licence Terms.
Marketplace licences are non-exclusive unless a separate legally binding agreement expressly provides otherwise.
Buyers must not resell, redistribute or sublicense purchased files outside the rights granted by the applicable licence.
Full licence details are available in our Marketplace Licence Terms.
7. Creator ownership and permissions
Creators retain copyright and other ownership rights in content they lawfully own, subject to rights they have already granted to others.
By uploading or publishing content, creators confirm that they own the necessary rights or have obtained valid permissions to upload, display, license and distribute the content through KaivosFocus.
Creators must obtain any legally required permissions concerning identifiable people, private property, trademarks, copyrighted material and other protected subject matter.
Creators grant KaivosFocus a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize and display uploaded content as reasonably necessary to operate the service, display listings and promote the creator's published listings.
This permission does not transfer copyright to KaivosFocus. Removal of content ends ongoing promotional use within a reasonable period, subject to existing purchases, technical copies, backups and lawful retention obligations.
8. Creator payments and platform fees
Marketplace purchases may involve a platform commission and payment-processing charges. Applicable seller fees, commissions and payment arrangements are governed by the Seller Terms and relevant transaction information.
Payments and creator payouts may be processed through Stripe and Stripe Connect, subject to provider requirements, verification, supported countries and account eligibility.
KaivosFocus does not guarantee immediate access to funds or a fixed payout date. Payment providers may apply settlement periods, verification requirements, holds or restrictions.
Sellers may be responsible for appropriate adjustments following refunds, chargebacks, reversed purchases or other payment disputes, as described in the Seller Terms and subject to applicable law.
See our Seller Terms for further information.
9. Prices, currencies and taxes
Prices may be displayed and charged in different supported currencies. The applicable purchase price, currency and available payment arrangements are determined by the checkout information provided for the transaction.
Applicable taxes, including GST, VAT or sales tax, may depend on the location of the buyer and seller, the nature of the product and relevant tax laws.
KaivosFocus and individual sellers must meet their respective legal tax obligations. Sellers remain responsible for tax reporting and obligations legally assigned to them.
Nothing in these Terms changes tax responsibilities imposed by applicable law.
10. Refunds, cancellations and disputes
Refunds and cancellations are governed by our Refund Policy and any mandatory consumer rights applicable to the transaction.
Where legally permitted, change-of-mind refunds are generally not offered after digital content has been made available to the buyer.
Customers remain entitled to remedies required by applicable law for defective, misrepresented, unavailable or undelivered content and services.
Where a full refund is legally required, KaivosFocus will not deduct its marketplace commission or internal processing costs from that refund.
See our Refund Policy.
Refund requests and payment disputes can be sent to kaivosfocus@gmail.com.
11. Refunded digital licences
When a digital purchase is validly refunded and cancelled, the corresponding licence entitlement may end and future authenticated downloads may be disabled.
Customers must not continue making new use of content under a licence that has validly ended, subject to applicable law and any surviving rights.
KaivosFocus cannot remotely delete files already downloaded by a customer. Rights arising from prior lawful use remain subject to the licence and applicable law.
12. Jobs and creator services
KaivosFocus may provide creator discovery, professional profiles, job listings and communication tools that help individuals and businesses connect.
Unless expressly stated for a particular service, KaivosFocus is not the employer, agent or contracting party performing an independently arranged creative engagement.
Users remain responsible for agreeing project scope, payment, delivery conditions, safety, qualifications and other terms of their off-platform arrangements.
Users must not publish fraudulent jobs, misrepresent opportunities or use the platform for unlawful recruitment or exploitation.
13. Education and mentoring
Educational offerings may include courses, learning materials, mentoring and other creator-provided educational services.
Creators must accurately describe their offerings and must not falsely claim professional qualifications, accreditation or expertise.
Unless expressly stated, KaivosFocus does not independently certify every creator or guarantee educational outcomes, employment opportunities or professional accreditation.
Consumers retain applicable rights concerning misleading descriptions, failure to supply services and other legal requirements.
14. Pro memberships
Where KaivosFocus offers paid Pro memberships, the applicable features, prices, billing periods and renewal arrangements will be governed by the terms and disclosures presented when subscribing.
Recurring memberships continue until cancelled according to the applicable subscription terms. Any required notice, consent and cancellation rights under local law remain available.
Cancelling a subscription generally stops future renewals once the cancellation takes effect. Refunds for an existing billing period remain subject to the Refund Policy and applicable law.
Material changes to paid membership benefits remain subject to applicable contractual and statutory protections.
15. Prohibited activity
Users must not publish or distribute unlawful content, infringe intellectual property rights, commit fraud, harass others, exploit minors, manipulate platform rankings or misuse accounts.

KaivosFocus is not intended to facilitate unlicensed financial services, personal money transmission or transactions prohibited by law.
Further restrictions are described in our Content Safety and Prohibited Activity rules.
16. Copyright complaints and moderation
KaivosFocus may remove content, restrict features, suspend accounts or take other proportionate action when reasonably necessary to respond to intellectual property complaints, unlawful activity, fraud, security risks or violations of platform rules.
Users may report suspected copyright infringement, unlawful content or account misuse using the website's reporting tools or by contacting KaivosFocus support.
Users affected by moderation decisions may request a review by contacting us, subject to applicable platform procedures and laws.
Copyright-related complaints may also be made through our Copyright Complaint page.
17. Privacy and personal information
KaivosFocus collects and processes information needed to operate accounts, provide services, process transactions, maintain security and meet legal obligations.
Privacy practices, relevant third-party providers and individual rights are explained in our Privacy Policy.

18. International availability
KaivosFocus is designed for an international audience. However, services, seller registration, currency options, payment methods and payouts may not be available in every jurisdiction.
Access may be restricted where required by sanctions, export controls, applicable laws, payment-provider requirements or platform security considerations.
Users are responsible for complying with laws applicable to their own conduct. KaivosFocus remains responsible for obligations legally imposed on the platform.
19. Mandatory international consumer rights
Customers retain mandatory consumer rights applicable to their location and transaction. These may include Australian Consumer Law, New Zealand consumer protections, UK consumer law, European Union and EEA consumer rules, and applicable laws in Japan, Singapore, Canada and the United States.
Laws concerning digital-content delivery, withdrawal periods, online contracting, unfair contract terms, recurring payments, privacy and statutory remedies may differ between jurisdictions.
No provision of these Terms removes rights that applicable law does not permit us to exclude or restrict.
20. Service availability and limitations
KaivosFocus aims to provide a reliable and secure service, but temporary interruptions, maintenance, third-party outages and technical faults may occur.
We do not guarantee uninterrupted access, particular sales results, creator earnings, employment outcomes or complete protection against unauthorised copying of publicly displayed content.
Nothing in this section excludes guarantees, warranties or other rights that cannot lawfully be excluded.
21. Responsibility and liability
Each user is responsible for their own unlawful conduct, content and breaches of these Terms to the extent permitted by applicable law.
KaivosFocus is responsible for its own conduct and obligations to the extent required by applicable law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability arising under applicable mandatory consumer protections.
Any contractual limitation of liability must be interpreted consistently with those mandatory protections.
22. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia, except to the extent that mandatory laws applicable to a particular customer or transaction require otherwise.
Customers retain any mandatory right to bring complaints or proceedings before competent courts, regulators or consumer dispute bodies in their applicable jurisdiction.
Before beginning formal proceedings, users are encouraged, but not required where prohibited by law, to contact kaivosfocus@gmail.com so the matter can be investigated.
23. Changes to these Terms
KaivosFocus may update these Terms to reflect changes to services, business practices, legal obligations or security requirements.
