1. About Marketplace licences
KaivosFocus enables eligible creators to offer digital creative works for licensing to buyers.
A Marketplace purchase grants the buyer permission to use the purchased work under the specific licence selected and recorded with that purchase.
All Marketplace licence tiers described here allow commercial use worldwide and are non-exclusive. Copyright and ownership of the underlying creative work are not transferred to the buyer.
The creator remains the copyright owner or an authorised licensor of the work.
2. Available licence options
Creators may offer one, two or all three supported Marketplace licence tiers:
- Standard — commercial use for 12 months.
- Extended — commercial use for 24 months.
- Full — commercial use without a fixed expiry date.
Only licence tiers actually offered by the creator for a particular listing are available for purchase.
The licence selected and recorded with the completed order determines the buyer's rights. Changes to a listing after purchase do not automatically change the licence already granted.
3. Standard Licence — 12 months
The Standard Licence permits worldwide, non-exclusive commercial use of the purchased work for 12 months from the purchase date.
Permitted uses include ordinary business, advertising, marketing, websites, social media, presentations and publications, subject to these Licence Terms and applicable law.
Once the licence term expires, the buyer must obtain a new applicable licence before making new commercial publications, distributions or other new licensed uses of the work.
The Standard Licence does not transfer copyright or grant exclusive rights.
4. Extended Licence — 24 months
The Extended Licence permits worldwide, non-exclusive commercial use of the purchased work for 24 months from the purchase date.
It permits ordinary commercial uses including business communications, advertising, marketing, websites, social media, presentations and publications, subject to these Licence Terms.
The Extended Licence provides a longer usage period than the Standard Licence. It does not grant copyright ownership or exclusivity.
After the 24-month period, a new applicable licence is required for new commercial publications, distributions or other new licensed uses.
5. Full Licence — no expiry
The Full Licence permits worldwide, non-exclusive commercial use of the purchased work without a fixed licence expiry date.
The buyer may continue making permitted commercial uses of the work without renewing the licence solely because time has passed.
The Full Licence remains subject to the restrictions in these Licence Terms, applicable law and any lawful termination of the licence.
Full does not mean exclusive ownership, copyright transfer or unrestricted redistribution of the original files.
The creator may continue using and licensing the same work to other buyers.
6. Permitted commercial use
Subject to the purchased licence term and applicable restrictions, a buyer may incorporate the licensed work into ordinary commercial projects and completed creative materials.
Examples include websites, advertisements, social media campaigns, presentations, publications and marketing materials.
The buyer may make reasonable technical adjustments needed to incorporate the work into a permitted project, subject to applicable moral rights, third-party rights and any restrictions disclosed with the work.
Commercial permission does not create independent rights to use third-party trademarks, music, identifiable individuals or other protected subject matter.
7. Non-exclusive licensing
All three KaivosFocus Marketplace licence tiers are non-exclusive.
Purchasing a licence does not prevent the creator from using, displaying or licensing the same work to other customers.
A buyer must not claim to be the exclusive owner or copyright holder solely because a Marketplace licence was purchased.
No exclusive licence, copyright assignment or ownership transfer is created unless a separate legally binding written agreement expressly provides otherwise.
8. Prohibited resale and redistribution
Unless expressly authorised in the applicable purchase agreement, buyers must not:
- Resell the original photograph, video or digital work as a standalone asset.
- Redistribute the original file through another stock media marketplace.
- Upload or distribute the original file for others to download as a substitute for purchasing a licence.
- Grant independent sublicences to use the original work outside the rights provided by the purchased licence.
- Falsely claim authorship, copyright ownership or exclusivity.
Incorporating a licensed work into a permitted completed project is different from reselling the original work as a competing stock asset.
9. Creator rights and responsibilities
Creators must own or control the rights necessary to offer their work for the licences they make available.
Creators must accurately describe the work and disclose material licensing limitations.
Where applicable, creators must obtain necessary model releases, property permissions, copyright permissions and other legally required authorisations.
A creator must not offer commercial rights that the creator does not legally possess.
Additional obligations are described in our Creator & Seller Terms.
10. Buyer responsibilities
Buyers are responsible for using purchased works within the scope and duration of the licence actually purchased.
Buyers must assess whether an intended use requires additional permissions, clearances or compliance with advertising and consumer laws.
A buyer must not use licensed content unlawfully, deceptively, in a defamatory manner or in a way that infringes the rights of other parties.
Use of a licensed work must also comply with applicable privacy, publicity, intellectual-property and other laws.
11. Worldwide territory and local laws
Worldwide licensing describes the geographical scope of permission granted by the copyright owner or authorised licensor.
It does not override the laws of a country in which the work is used.
Buyers remain responsible for any additional legal requirements applicable to their intended use.
Licences do not authorise transactions or uses prohibited by applicable sanctions, export controls or other laws.
12. Refunds and licence cancellation
Refunds are governed by the KaivosFocus Refund Policy and applicable mandatory consumer law.
Where a purchase is validly cancelled and fully refunded, the associated licence entitlement may end to the extent permitted by law.
KaivosFocus may disable future authenticated downloads for a cancelled or refunded purchase.
Customers must not make new uses under a licence that has validly ended.
KaivosFocus cannot remotely delete copies of files already downloaded. Any surviving rights concerning prior lawful use remain subject to applicable law.
13. Intellectual property complaints
KaivosFocus may investigate reports that a listed work infringes intellectual property or other legal rights.
Where reasonably necessary, we may restrict or remove disputed listings, preserve relevant records and request information from the creator.
Buyers and creators may submit copyright-related concerns through our Copyright Complaint page or contact KaivosFocus support.
Nothing in these terms removes any statutory remedy or legal protection that cannot lawfully be excluded.
14. Changes to these Licence Terms
KaivosFocus may update these Licence Terms to reflect service changes, legal requirements or future licensing arrangements.
Updated terms will be published on the website.
Changes do not automatically alter licence rights already granted under completed purchases or remove rights protected by applicable law.
