Creator & Seller Terms
These terms govern selling digital content, offering education and receiving payments through KaivosFocus. They supplement our Terms of Use, Marketplace Licence Terms and Refund Policy.
Launch draft · Last updated 10 September 2026
1. Platform operator and contact
KaivosFocus is operated from Queensland, Australia by Taylor Jett Carson Black, an Australian sole trader.
For seller support, payment enquiries, copyright concerns or disputes, contact kaivosfocus@gmail.com.
2. Agreement and eligibility
These Creator & Seller Terms apply when you upload, publish, license or sell content, or offer paid educational services through KaivosFocus.
Sellers must meet applicable legal eligibility requirements, provide accurate account information and comply with our platform rules.
Selling features and payouts are available only in locations supported by KaivosFocus and its relevant payment providers.
We may require identity, residency, business, tax or other verification before allowing selling or releasing payments.
3. Ownership of your creative work
You retain copyright and other ownership rights in content that you lawfully own.
Uploading content to KaivosFocus does not transfer copyright ownership to the platform.
You confirm that you own or control the rights necessary to upload, reproduce, display, license and distribute each work you submit.
You must not upload stolen, infringing, unlawfully obtained or otherwise unauthorised material.
4. Model releases and other permissions
Creators are responsible for obtaining permissions and releases required by applicable law and by the intended uses they offer to buyers.
These may involve identifiable people, private property, trademarks, copyrighted works, protected locations and other third-party rights.
Possessing a photograph or video does not necessarily mean you possess every right needed to license it commercially.
Sellers must disclose material restrictions that could affect the lawful use of a work and must not offer rights they cannot grant.
5. Permission to operate the platform
By uploading content, you grant KaivosFocus a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, resize, display and deliver that content as reasonably necessary to operate the platform.
This includes displaying listings, thumbnails, previews, watermarks, creator portfolios and promotional references to publicly published listings.
This permission does not transfer copyright ownership to KaivosFocus or permit us to sell unrelated ownership rights in your work.
After removal of a listing, continued handling may be necessary for existing lawful purchases, records, disputes, backups and legal obligations.
6. Accurate listings and descriptions
Sellers must provide accurate, clear and non-misleading descriptions of their content.
Listings should identify material limitations, relevant licence choices, applicable prices and any information required by law.
Sellers must not misrepresent ownership, originality, technical specifications, permissions, qualifications or intended uses.
Where required by applicable law, commercial sellers must provide appropriate business and consumer-facing disclosures.
7. Marketplace licences
Eligible creators may offer the licence options made available through KaivosFocus, including Standard, Extended and Full licences.
Creators may choose which supported licence options to offer. Buyers receive only the licence actually purchased and recorded with the relevant order.
The applicable licence determines the permitted uses, duration and restrictions. Full licence details are governed by our Marketplace Licence Terms.
Marketplace licences are non-exclusive unless a separate binding agreement expressly states otherwise. No licence automatically transfers copyright ownership to the buyer.
8. Marketplace commission
For standard digital Marketplace sales, KaivosFocus's current platform commission is 20% of the applicable item sale price, with 80% allocated as the creator's share, before any applicable adjustments.
For example, on an eligible A$10.00 sale with no adjustment, the platform commission is A$2.00 and the creator allocation is A$8.00.
Actual transaction records, supported currencies, taxes, refunds, currency conversions and applicable payment-provider arrangements may affect settlement and the amount ultimately paid out.
A different fee for a particular offering or programme must be disclosed before the affected transaction. The Marketplace commission is not automatically the fee charged for Education, mentoring or unrelated services.
Any future change in commission affecting sellers will be disclosed as required by applicable law and will not retrospectively change the agreed commission on completed purchases.
9. Stripe Connect and seller payouts
KaivosFocus uses supported payment providers, including Stripe and Stripe Connect, to process marketplace payments and eligible creator transfers.
Sellers may need to accept separate payment-provider agreements and complete identity, business, banking and tax verification.
Payment-provider approval, transfer eligibility and payout availability are not guaranteed merely by creating a KaivosFocus account.
Payments may be delayed or restricted because of settlement timing, verification, provider limitations, suspected fraud, disputes or legal requirements.
KaivosFocus does not guarantee a particular bank payout date or that every currency can be paid out in its original form.
10. Refunds and seller adjustments
Customer refunds are governed by our Refund Policy and applicable mandatory consumer law.
If a purchase is refunded, the corresponding seller earnings may be adjusted or recovered to reflect the refunded transaction.
Where permitted by applicable law and payment-provider rules, KaivosFocus may seek to reverse an associated seller transfer, apply an appropriate adjustment against available seller balances, or request repayment of an amount properly owed.
A buyer refund does not automatically guarantee successful recovery of funds already transferred to a seller or paid into a bank account.
KaivosFocus will maintain appropriate transaction records and make reasonable efforts to investigate disputed adjustments.
Sellers must cooperate with legitimate refund investigations and comply with mandatory consumer remedies. No term here removes any consumer right that applicable law protects.
11. Chargebacks and payment disputes
A customer or payment provider may dispute a transaction, including through a card chargeback or other recognised process.
Sellers must provide accurate information reasonably requested to investigate relevant disputes, including evidence concerning the listing, delivery, permissions and licence purchased.
Where a transaction is validly reversed, the associated seller earnings may be adjusted or recovered as permitted by law and applicable agreements.
Any additional dispute-related charge imposed on a seller must have a lawful contractual basis and be appropriately disclosed. These Terms do not introduce an automatic additional chargeback penalty.
12. Taxes and financial records
Sellers are responsible for understanding and meeting their applicable tax obligations, including income tax, business registration and relevant recordkeeping requirements.
Depending on the transaction and jurisdiction, GST, VAT, sales tax, withholding or other obligations may apply.
Where the law places collection, reporting, withholding or remittance responsibilities on KaivosFocus or a payment provider, those responsibilities remain with the legally responsible party.
Sellers must provide accurate tax information when reasonably required for compliance. KaivosFocus does not provide individual tax or accounting advice.
13. Education and creator services
Creators offering educational products or services must accurately describe what purchasers will receive.
Educational listings must not falsely claim accreditation, professional qualifications, guaranteed outcomes or endorsements.
Any separate price, commission, subscription requirement or cancellation condition applicable to an Education offering must be disclosed through the relevant purchase arrangement.
Sellers remain responsible for lawful delivery of their content or services, subject to KaivosFocus's own legal obligations.
14. Jobs and independent engagements
KaivosFocus may provide Jobs, creator discovery and contact features that connect creators with potential clients.
Unless a particular service expressly states otherwise, agreements independently arranged between users are not employment agreements with KaivosFocus.
The parties are responsible for agreeing the work, payment, timing, safety, qualifications and other relevant conditions.
Ordinary off-platform jobs and independently arranged services are not automatically subject to the Marketplace's 20% commission.
15. International seller disclosures
Sellers must comply with laws applicable to their location, the markets in which they sell and the products or services they offer.
This may involve providing legal business names, registration numbers, business addresses, contact information, tax details, cancellation terms or other required disclosures.
For applicable sales involving European Union consumers, marketplace and trader-traceability requirements may require verification and disclosure of relevant trader information.
Japanese commercial sellers may be subject to disclosure requirements under the Act on Specified Commercial Transactions, including rules concerning the seller's identity, contact information and sales conditions.
Additional consumer and ecommerce rules may apply in Australia, New Zealand, the United Kingdom, Singapore, Canada, the United States and other supported markets.
KaivosFocus may request additional information or restrict transactions where reasonably necessary to meet applicable legal or payment-provider requirements.
16. Content protection and previews
KaivosFocus may use previews, thumbnails, watermarks, restricted downloads and other technical measures to help protect creative work.
These measures are intended to discourage unauthorised copying and help manage purchase entitlements.
No public online preview can be guaranteed completely protected against screenshots, extraction or unauthorised reuse.
Sellers should upload only material they are comfortable displaying under the platform's available preview arrangements.
17. Prohibited seller activity
Sellers must not use KaivosFocus for fraud, illegal transactions, intellectual-property infringement, misleading listings or the sale of content they lack authority to license.
Sellers must not manipulate transactions, create artificial sales, evade account restrictions, harass users or interfere with security controls.
Further restrictions are set out in our Content Safety and Prohibited Activity rules.
18. Moderation and account restrictions
KaivosFocus may review reported listings, investigate complaints and take proportionate action where reasonably necessary to enforce platform rules or comply with law.
Actions may include restricting a listing, removing content, limiting selling access or suspending an account.
Where appropriate and legally required, we will provide relevant notices, reasons and opportunities for review.
Closing an account does not automatically remove obligations concerning completed sales, valid licences, outstanding disputes or lawful financial records.
19. Liability and mandatory rights
Sellers are responsible for their own unlawful conduct, inaccurate representations and breaches of these Terms to the extent permitted by applicable law.
KaivosFocus remains responsible for obligations legally imposed on the platform.
Nothing in these Terms excludes or restricts consumer guarantees, seller rights, privacy protections or other mandatory legal rights that cannot lawfully be excluded.
20. Governing law and disputes
These Terms are governed by the laws of Queensland, Australia, except where mandatory laws applicable to a seller or transaction require otherwise.
Sellers may contact KaivosFocus to raise questions or disputes about platform decisions, payments or account access.
Nothing in this section removes a legal right to approach a competent court, regulator or dispute-resolution body.
21. Changes to Seller Terms
KaivosFocus may update these Seller Terms to reflect changes in applicable law, payment providers or platform services.
Where legally required, affected sellers will receive appropriate notice or an opportunity to accept material changes.
Changes do not retrospectively remove legally protected rights or alter completed transaction terms without a lawful basis.
22. Support and related policies
For seller assistance, transaction enquiries or account disputes, email kaivosfocus@gmail.com.
These Seller Terms should be read together with our Terms of Use, Marketplace Licence Terms, Refund Policy and Privacy Policy.
